1. Acceptance of Terms
Plastle GmbH ("Plastle", "we", "us") provides the PlastCast platform and related digital services for plastics-industry organizations. By creating an account or accessing any Plastle property, you acknowledge that you are at least 18 years old (or the age of majority in your jurisdiction), that you are authorized to agree on behalf of yourself or your business, and that you will comply with these Terms and our Privacy & Cookie Policy.
2. Accounts and Eligibility
- You must provide accurate registration information and keep it current.
- You are responsible for safeguarding your credentials and for all actions taken through your account.
- If you access Plastle services on behalf of an organization, you confirm you have authority to bind that entity, and these Terms apply to both you and the organization.
We reserve the right to suspend or terminate accounts for suspected abuse, security concerns, or violations of these Terms.
3. Subscriptions, Trials, and Billing
- PlastCast paid plans are billed monthly or annually in advance and renew automatically until canceled.
- Downgrades or cancellations take effect at the end of the current billing cycle; previously paid fees are non-refundable unless required by law.
- Certain beta capabilities may be offered at no cost and can be modified or withdrawn at any time.
- Taxes, currency conversion fees, and third-party transaction charges are your responsibility.
4. Acceptable Use
When engaging with PlastCast, you agree to:
- Use the platform only for lawful, professional communications related to plastics industry content.
- Avoid uploading malware, scraping data without consent, reverse-engineering our software, or interfering with system stability.
- Obtain necessary rights for any audio, imagery, or data you submit and ensure it does not infringe third-party intellectual property, publicity, or privacy rights.
We may monitor usage patterns to maintain service integrity, improve performance, and enforce these acceptable use requirements.
5. Intellectual Property
All site copy, visuals, source code, databases, and trade names (including Plastle and PlastCast) are owned or licensed by Plastle. Except for the limited right to use the services while your subscription is active, no license or ownership interest transfers to you. Feedback or suggestions may be used without obligation.
6. Product and Content Changes
We continually iterate on PlastCast and other Plastle services. Features, integrations, and content libraries may change, and we may discontinue any offering with reasonable notice. Where practicable, we will provide advance notice of materially adverse changes through email or in-product messaging.
7. No Financial or Investment Advice
Information shared through PlastCast episodes, dashboards, or marketing collateral is provided for general industry education only. Plastle does not offer investment, securities, commodity, or financial advisory services. You should not rely on any Plastle content to make trading, procurement, or financial decisions. Always consult qualified advisors before acting on business-critical information.
8. AI-Enabled Features and Human Oversight
Certain Plastle workflows, such as automated show-note generation or audio clean-up, may leverage third-party AI providers under strict data processing agreements. We log prompts and outputs to diagnose quality issues, and humans review critical communications before public distribution. Do not use AI outputs as the sole basis for regulatory, safety, or legal decisions.
9. Third-Party Services
PlastCast integrates with hosts, analytics suites, and collaboration tools. Third-party terms govern your use of those services. Plastle is not liable for outages or changes caused by external platforms, though we will make commercially reasonable efforts to maintain compatibility with the partners we publicly document.
10. Limitation of Liability
To the fullest extent permitted by law, Plastle and its affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability for any claim arising out of these Terms will not exceed the amounts you paid to Plastle in the 12 months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Plastle, its officers, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your content, your breach of these Terms, or your violation of applicable law.
12. Termination
You may cancel at any time inside your account settings. We may terminate or suspend access immediately if you materially breach these Terms, fail to pay fees, or create risk for other customers. Upon termination, your right to use the services stops, but sections intended to survive (e.g., intellectual property, indemnity, limitation of liability) remain in effect.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules. The courts of Saarbrücken, Germany, have exclusive jurisdiction for disputes where legally permitted, and either party may seek injunctive relief to protect intellectual property or confidential information.
14. Updates to These Terms
We may update these Terms to reflect product changes or legal requirements. We will post the updated version with a new effective date and, when changes are material, notify account owners via email. Continued use after the effective date constitutes acceptance.
