1.1     The Plastle Site (hereafter referred to as Site) is provided by Plastle S.A. (hereafter referred to as Plastle).

1.2     Please review this following terms of use (hereafter referred to as terms) carefully.

1.3     By accessing, browsing, or using Plastle Site, you acknowledge that you have read, understood, and agree to be bound by these terms. 

1.4     If you do not agree to these terms you are not authorized to use this Site.

3.3     Plastle does not warrant or make any representations regarding the use, validity, accuracy, or reliability of, or the results of use of, the materials on this Site or any sites linked to this Site, including any advertisements or services provided by any third parties.

3.4     Plastle does not warrant that the Site will be accessible at all times or in all geographic areas, nor does it warrant that materials accessible via this Site are free from viruses, worms or other harmful effects.

4.1     You acknowledge and agree that Plastle has no control over and assumes no responsibility for the quality, safety, or legality of any products or services sold or offered for sale by any third-party, the truth or accuracy of any advertisements, materials or promotions of any third-party, or the false, misleading, defamatory, infringing, obscene or unlawful statements of any third-party. 

4.2     You agree to pursue any problems or grievances you may have directly with the responsible third-party only.

4.3     Under no circumstances shall Plastle nor any other party involved in creating, producing, or delivering the materials or services on Plastle Site, be liable for any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to any loss of data, loss of business, loss of profits or loss of use, arising out of the use or inability to use the materials on this Site, even if Plastle has been advised of the possibility of such damages.

4.4     Some countries do not allow exclusion of implied warranties or Limitation of liability for incidental or consequential damages. In countries with such jurisdictions you are not authorized to use the Plastle Site.

5.1     The Plastle Site contains links to other Web sites.

5.2     Plastle is not responsible for the content, accuracy or opinions express in such web Sites, and such web sites are not investigated, monitored or checked for accuracy or completeness by us.

5.3     Inclusion of any linked web site on Plastle Site does not imply approval or endorsement of the linked web site by Plastle.

6.1     We allow contact to manufacturers or distributors (collectively hereafter referred to as suppliers) from which you may purchase certain goods or services.

6.2     You understand that we do not operate or control the products or services offered by these suppliers.

6.3     Suppliers are responsible for all aspects of order processing, fulfillment, billing and customer service.

6.4     We are not a party to the transactions entered into between you and these suppliers.

6.5     You agree that use of such suppliers is at your sole risk and is without warranties of any kind by us, expressed, implied or otherwise including warranties of title, fitness for purpose, merchantability or noninfringement.

6.6     Under no circumstances we are liable for any damages arising from the transactions between you and suppliers or for any information appearing on supplier sites or any other site linked to our Site.

6.7     Plastle explicitly points out that any decision about the application of materials must be double checked with the producer or the supplier of this material.

7.1     The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks and other proprietary rights.

7.2     You do not acquire ownership rights to any content, document or other materials viewed through the Site.

7.3     The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials.

7.4     The viewing, printing or downloading of any content, graphic, form or document from the Site grants you only a limited, nonexclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works or other use.

7.5     No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use.

8.1     You may not use any of the names, trademarks, service marks or logos of Plastle that appear on this Site in any advertising or publicity, or otherwise to indicate, whether directly or indirectly, affiliation with any product or service, without the express written consent of Plastle.

8.2     Other product and company names mentioned on the Site are either trademarks or registered trademarks of their respective owners.

8.3     You agree to indemnify, defend and hold us and our partners, attorneys, staff and affiliates harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this agreement or use of the Site.

9.1     You agree that you are responsible for safeguarding the confidentiality of your user-id and password and for preventing their disclosure or release to any third party.

9.2     You agree to immediately report any unauthorized use of your password or account to:

9.3     You agree to accept all risks associated with the unauthorized use of your lost or stolen user-id or password. You are fully responsible for all transactions and other activities that are undertaken using your user-id or password.

9.4     Any right given to you within your User Account is not transferable.

9.5     You may not post or transmit any content that you do not have the right to post or transmit.

9.6     You ensure that you exit from restricted areas at the end of each session.

10.1   You acknowledge and agree that Plastle may terminate access to all or part of the services  available on this Site without prior notice if you engage in any conduct or activities that Plastle, in its sole discretion, believes violates any of these terms.

10.2   Neither Plastle nor any of its affiliates shall be liable to you in the event of such termination.

10.3   Except as otherwise provided in specific areas or portions of this Site, any communication or material you transmit to Plastle by electronic mail or otherwise, including any data, questions, responses to questionnaires, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary.

10.4   Anything you transmit or post may be used by Plastle or its affiliated companies for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast, and posting in any form or media or any other existing future technology.

10.5   Plastle is free to use any ideas, concepts, know-how, techniques or price-information contained in any communication you send to the Site for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products using such information.

10.6   Plastle reserves the right in its sole discretion to edit or delete any documents, information or other content appearing on the Plastle Site.

11.1   Plastle make no representation that materials in this Site are appropriate or available for use in any particular location.

11.2   By using or downloading content or features of an Plastle Site, you assume the responsibility for doing in compliance with the law that applies in jurisdictions where you are located.

11.3   Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws.

12.1   This agreement shall be treated as though it were executed and performed in Luxemburg, and shall be governed by and construed in accordance with the laws of Luxemburg.

12.2   To the extent that anything in or associated with the Site is in conflict or inconsistent with this agreement, this agreement shall take precedence.

12.3   Our failure to enforce any provision of this agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision.

12.4   To the extent any dispute is not resolved, the parties agree not to commence or prosecute any suit or claim to enforce these terms or otherwise arising under or by reason of these terms, other than in the courts of Luxemburg.

12.5   Any cause of action by you with respect to the Plastle Site must be instituted within one year after the cause of action arose or be forever waived and barred.

12.6   The language in this agreement shall be interpreted as to its fair meaning and not strictly for or against either party.

12.7   If any provision of this agreement is found to be invalid, all other terms and conditions of this agreement shall remain unaffected and shall continue in full force and effect.

12.8   In the event that your access terminates as provided herein or you cease using the Plastle Site, these terms shall survive.
